Terms of Use

The following terms of use govern all use of the website CSME eApplication Portal and all content, services and products available at or through the website (taken together, "the Site") provided by the Ministry of Foreign and CARICOM Affairs (MFCA). The Site is offered subject to your acceptance, without modification, of all the terms of use contained herein and all other operating rules, policies and procedures that may be published from time to time on the Site (taken together, the "Agreement"). Please read this Agreement carefully before accessing or using the Site. By accessing or using any part of the Site, you agree to become bound by the terms of use in this Agreement. If you do not agree to all the terms of use in this Agreement, then you may not access the Site or use any services.


Use of Site

MFCA authorizes you to view and download the materials at this Site only for your personal, non-commercial use, provided that you maintain all copyright and other proprietary notices contained in the original materials on any copies of the materials. You may not modify the materials at this Site in any way or reproduce or publicly display, perform, or distribute or otherwise use them or any part of them for any public or commercial purpose without the written permission of the MFCA. For the purposes of this Agreement, any use of these materials or any part thereof on any other website or networked computer environment for any purpose is prohibited. The materials at this Site are copyrighted and any unauthorized use of any materials at this Site may violate copyright, trademark, and other laws. If you breach any of part of this Agreement, your authorization to use this Site automatically terminates and you must immediately destroy any downloaded or printed material.

While the MFCA makes every effort to keep CSME eApplication Portal up to date, it does not provide any guarantees, conditions or warranties that the information shall be:

  • Secure
  • Accurate
  • Complete
  • Free from bugs or viruses

The MFCA does not publish advice on the Site. You should get professional or specialist advice before doing anything on the basis of the content provided on the Site. The MFCA is not liable for any loss or damage that may come from using the Site. This includes:

  • Any direct, indirect or consequential losses
  • Any loss or damage caused by civil wrongs ('tort', including negligence), breach of contract or otherwise
  • The use of this Site and any websites that are linked to or from it
  • The inability to use this Site and any websites that are linked to or from it

This applies if the loss or damage was foreseeable, arose in the normal course of things or you advised the MFCA that it might happen.

General

The MFCA is not liable for any failure to comply with these terms of use because of circumstances beyond its reasonable control. The MFCA may decide not to exercise or enforce any right available to it under these terms of use but can always decide to exercise or enforce that right at a later date. Any non-enforcement of a right shall not be deemed to be an automatic waiver on the part of the MFCA in respect of subsequent breaches by you on other occasions. If any of these terms of use are held to be invalid, unenforceable or illegal for any reason, the remaining terms of use shall remain applicable.

Modification the Terms of Use

The MFCA may revise the content of this Agreement at any time by updating this posting under its Terms of Use. You should visit this page from time to time to review the current terms because they are binding on all users. You will agree to any changes if you continue to use this Site after the terms of use have been updated. Certain provisions of this Agreement may be superseded by expressly designated legal notices or terms located on particular pages at this Site.

Website content changes

CSME eApplication Portal is made available free of charge.
The MFCA does not guarantee that this Site, or any content on it, will always be available or be uninterrupted. The MFCA may suspend or withdraw or restrict the availability of all or any part of its Site for business and operational reasons. The MFCA shall try to give you reasonable notice of any suspension or withdrawal.

Keep your account details safe

If you choose or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you shall treat such information as confidential. You shall not disclose it to any third party.
The MFCA has the right to disable any user identification code or password, whether chosen by you or allocated by it, at any time, if in the MFCA's reasonable opinion you have failed to comply with any of the provisions of these terms of use.
If you know or suspect that anyone other than you knows your user identification code or password, you shall promptly notify us via the support options provided.

User Submissions

Other than personally identifiable information, which is covered under the Site's Privacy Policy (available on our homepage and at the bottom of each of the Site's web pages), any material, information or other communication a user of the Site transmits or post to this Site shall be considered non-confidential and non-proprietary (taken together as "Communications"). The MFCA has unlimited rights to such Communications and may use it for any purpose within our legal capacity. The MFCA and its designees shall be free to copy, disclose, distribute, incorporate and otherwise use the Communications and all data, images, sounds, text, and other things embodied therein for any and all commercial or non-commercial purposes. Users are prohibited from posting or transmitting to or from this Site any unlawful, threatening, libellous, defamatory, obscene, pornographic, or other material that would violate any law.

Viruses

You are responsible for configuring your information technology, computer programmes and platform to access the MFCA's Site. You should use your own virus protection software.
You shall not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You shall not attempt to gain unauthorized access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You shall not attack The MFCA's site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would deemed to commit a criminal offence under the Computer Misuse Act, Chap 11:17. The MFCA shall report any such breach to the relevant law enforcement authorities and shall co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site shall cease immediately.

Applicable Laws

This Agreement shall be governed in all respects by the substantive Laws of the Republic of Trinidad and Tobago. Any controversy, claim, or dispute arising out of or relating to the Agreement shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Trinidad and Tobago.
